The environmental planning and mobility team especially deals with cases that have much ground in common with e.g. the following ‘sub-areas’.
Environmental planning
LDR has gathered considerable practical experience in the field of legal assistance for the preparation of environmental planning plans (planning schemes, sectoral special planning schemes, spatial structure plans and spatial implementation plans). Within this scope a network of preferential relations with environmental planners was developed. LDR’s environmental planning and mobility team includes four environmental planners. LDR has a lot of expertise in preparing notices of objection and lodging appeals to the Council of State in legal proceedings against special planning schemes or spatial implementation plans.
Urban development permits – allotment permits
A large number of the cases dealt with by the environmental planning and mobility team relate to assistance with and legal support of urban development applications for large construction projects (e.g. industrial construction, office buildings, apartment buildings, allotments), infrastructure projects (e.g. construction of silt dumps, wind farms, dam works at sea) as well as for private homes.
Commencing administrative appeal proceedings or providing assistance in objection proceedings are also an important part of the cases dealt with.
Houses and companies not permitted under zoning regulations
The problem of houses and companies not permitted under zoning regulations is one of the pet subjects of the environmental planning and mobility team. This theme has been studied in depth from a scientific perspective (see overview of publications). The firm can in the mean time boast extensive expertise in this matter. Among other things, LDR’s environmental planning and mobility team provide assistance for companies not permitted under zoning regulations that want to expand and for the preparation of the planning certificate application file.
Urban development criminal law
The criminal prosecution of urban development offences has increasingly come to the fore over the past couple of years. The firm has also gathered extensive expertise in initiating criminal procedures before the correctional courts and the courts of appeal.
Expropriations
The firm has extensive experience in the field of expropriations, both as to conducting negotiations with an eye to an amicable settlement and as to initiating legal expropriation proceedings.
Damage and benefits resulting from changes in spatial plans
The firm also provides assistance in proceedings related to the problem of damage and benefits resulting from changes in spatial plans.
Monuments and landscapes
The firm is actively involved in numerous listed building classification files (negotiations or objections). Extensive experience has also been gathered in the demarcation of listed landscapes and the indication of anchorages.
Other environmental legislation areas
Last but not least, LDR’s environmental planning and mobility team also provides support in environmental files such as environmental permit or subsidy files (see e.g. relocalisation subsidies).
